A detailed decision to end the lifetime
disqualification of politicians is in progress
The 53-page decision was written by Chief
Justice Qazi Faiz Isa.
The concept of lifelong incapacity is not
compatible with the provisions of fundamental rights.
Zia-ul-Haq imposed martial law and added
life-long disqualification clause to Article 62.
Lifetime
disqualification is inconsistent with the right of the people to contest
elections and vote.
Article 62 1F, read alone, cannot be punished
under it
Former
judge Umar Atta Bandial wrote the verdict in the Samiullah Baloch case and
denied it himself.
Justice
Yahya Afridi's dissenting note was also included in the decision of the Supreme
Court. Justice Yahya Afridi remarked that

62 1f is limited to a declaration by a Court of Law, dissenting note
Disqualification remains as long
as there is a declaration by the Court of Law. Dissenting Note Justice Yahya
Afridi remarked that the decision of the Supreme Court in the Samiullah Baloch
case was correct.,
